Take two drug stores and call Jay Benanav in the morning

When the West St. Paul City Council had a work session on a proposed new CVS pharmacy at Robert and Thompson streets earlier this week, they met with an unlikely advocate for the drug store chain: retiring St. Paul City Council Member Jay Benanav.
Asked about representing CVS when he announced his retirement earlier this month, Benanav denied he was doing legal work for the company. But he confirmed on Wednesday that is working for
Velmeir Development, the company that actually builds the stores for CVS, as well as Home Depot, Blockbuster movie rental outlets and Staples office supply stores, among others. (Check out their client list here.)
It’s akin to the kind of “big box” retail of which Benanav has been highly critical in St. Paul -- including a CVS store that Velmeir built at University and Snelling Avenue in 2004.
“Life’s full of irony,” the Ward 4 representative said Wednesday, when asked about his legal work for Velmeir. He said he’d been working with them for about a year, but hadn’t represented them on any matters in St. Paul.
In stark contrast to his battles over the store being built in his ward for the Rhode Island-based pharmacy chain, Benanav had high praise for CVS this week.
“I think they’ve come a long way since St. Paul,” he said in an interview in his City Council office. “I think they really understand that they have to consider the needs of the community, and that it’s good for business to do so,” Benanav said. “Did I have anything to do with that?” he said, in response to a question. “I’d like to think so.”
West St. Paul Mayor John Zanmiller said he found Benanav and the Velmeir company generally cooperative with the city. The new drug store is planned for a parcel in front of the new Menards store on the city’s main thoroughfare.
“We think there’s a higher and better use for the property, but they have been very open and understanding,” Zanmiller said in an interview on Wednesday. “I think that if you asked 10 people in West St. Paul what they wanted to have in their city, none of them would say ‘another pharmacy.’ We have nine of them now. But I think Jay and the developers understand where we’re coming from.”

Agency decisions are presumed correct, and this court defers to an agency’s expertise and its special knowledge in the field of its technical training, education, and experience. In a hearing before an ALJ panel, the complainant bears the burden of proof, and a violation of Minn. Stat. § 211B.06 (2004), relating to false statements in campaign materials, must be proved by clear and convincing evidence. Minn. Stat. § 211B.32, subd. 4 (2004). To prove that Bernstein violated Minn. Stat. § 211B.06, Fine needed to prove by clear and convincing evidence that the campaign materials distributed by Bernstein contained false statements, and either that Bernstein knew the statements to be false, or that he recklessly disregarded whether the statements were false.

609.43 MISCONDUCT OF PUBLIC OFFICER OR EMPLOYEE.
A public officer or employee who does any of the following, for which no other sentence is
specifically provided by law, may be sentenced to imprisonment for not more than one year or to
payment of a fine of not more than $3,000, or both:
(1) intentionally fails or refuses to perform a known mandatory, nondiscretionary, ministerial
duty of the office or employment within the time or in the manner required by law; or
(2) in the capacity of such officer or employee, does an act knowing it is in excess of lawful
authority or knowing it is forbidden by law to be done in that capacity; or
